Reporting Claimed Copyright Infringement

  6. A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability. We recommend consulting with legal counsel before submitting a notification if you are uncertain whether the use in question actually constitutes infringement.

Our Process Upon Receiving a Valid Notice

Once we receive a complete and valid DMCA notification, we will:

  1. Review the notification to confirm it meets the requirements outlined above.
  2. Remove or disable access to the material identified as infringing, or otherwise take appropriate action.
  3. Make a good faith attempt to notify the user or contributor responsible for posting the material, providing them with a copy of the notification.
  4. Document the claim and our response for our internal records.

We reserve the right to remove content that we believe, in our sole discretion, may infringe the intellectual property rights of others, even in the absence of a formal DMCA notification.

Counter-Notification

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. Your counter-notification must include the following, in writing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location where it appeared before removal.
  3. A statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the United States, an appropriate judicial district in which the site operator may be found), and that you will accept service of process from the person who submitted the original DMCA notification, or their agent.

Upon receiving a valid counter-notification, we may, at our discretion, restore the removed material within 10 to 14 business days, unless the original complaining party notifies us that they have filed a court action seeking a restraining order against the alleged infringer.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances, the accounts or access of users who are determined to be repeat infringers. We reserve the right to make the final determination of what constitutes repeat infringement on a case-by-case basis and to remove content or suspend access at our sole discretion.

Modifications to Content

If content has been modified or removed in response to a DMCA notification, we may indicate on the site that the material has been removed or replaced due to a claim of copyright infringement, without disclosing further details of the specific claim unless required to do so.

False Claims and Misuse

Submitting a false or bad-faith DMCA notification or counter-notification may expose you to legal liability, including damages, costs, and attorneys’ fees incurred by us or by the party against whom the claim was made. We take misuse of this process seriously and reserve the right to take appropriate action, including denying future submissions from parties found to have submitted knowingly false claims.

Limitations of This Policy
